Terms and Conditions 

1. EMOTIONAL, PHYSICAL, AND MENTAL WELL-BEING. I understand and agree that I am fully responsible for my physical, mental, and emotional well-being during the live retreat, including my choices and decisions. I understand that as part of this retreat, I am entering into a Professional-Client relationship that is designed to facilitate the creation/development of personal, professional, or business goals and to develop and carry out a strategy/plan for achieving those goals. I understand that this retreat may involve all areas of my life, including work, finances, health, relationships, education, and recreation. I acknowledge that deciding how to handle these issues, I have incorporated coaching into those areas, and implementing my choices is exclusively my responsibility, and I do not hold the coach liable for my actions. I understand that this retreat does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association. I understand that this retreat is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care, or substance abuse treatment and I will not use it in place of any form of diagnosis, treatment, or therapy. I promise that if I am currently in therapy or otherwise under the care of a mental health professional, that I have consulted with the mental health care provider regarding the advisability of attending this retreat and that this person is aware of my decision to proceed with my attendance.  I understand that this retreat is not to be used as a substitute for professional advice by legal, medical, financial, business, spiritual, or other qualified professionals. I will seek independent professional guidance for legal, medical, financial, business, spiritual or other matters. I understand that all decisions in these areas are exclusively mine and I acknowledge that my decisions and my actions regarding them are my sole responsibility. 
2. CONFIDENTIALITY. I understand that information will be held as confidential unless I state otherwise, in writing, except as required by law. I agree that I will hold all information shared by the host and other guests at the retreat as confidential. I understand that certain topics may be anonymously and hypothetically shared with other mentoring professionals for training OR consultation purposes. 
3. REFUND POLICY. Due to the time, money and energy to plan the retreat and secure the retreat location, the Company must balance the risk of investing in the planning and preparation of the retreat with the threat of COVID or other natural events affecting our gathering. As such, we can only offer partial refunds as follows: 
1. YOU MAY SELL OR GIFT YOUR SPOT TO A FRIEND, as long as they also agree to these terms.

1. IN CASE RETREAT IS CANCELED: If the retreat gets canceled for reasons beyond the Company’s control, such as a statewide lockdown, a massive surge of infections or other natural disaster, you will receive your money back, minus a $400 admin fee to cover planning time and expenses incurred.
2. THERE ARE NO REFUNDS IF YOU CHOOSE NOT TO COME ON THE RETREAT. If you get sick, or decide to cancel for any reason, the Company will make all attempts to fill your space. If your space is filled, you will receive your money back, minus the $400 admin fee.
3. By submitting my payment, I acknowledge I am responsible for paying the total amount of the retreat, whether I decide to stop participating at any time. There are no retreat cancellations or postponements unless the retreat is canceled. 

1. TRAVEL INSURANCE. I acknowledge the Company has recommended the retreat participants purchase travel insurance. 
2. MEDIA. In exchange for participation in the activity of the retreat,  hereinafter known as the “Media”, I grant the Company to use my image (photographs and/or video) for use in Media publications including videos, email blasts, newsletters, general marketing, website and other marketing materials. I hereby waive any right to inspect or approve the finished photographs or electronic matter that may be used in conjunction with them now or in the future, whether that use is known to me or unknown, and I waive any right to royalties or other compensation arising from or related to the use of the image. I certify that I fully understand the contents, meaning and impact of this release. I understand that I am free to address any specific questions regarding this release by submitting those questions in writing prior to signing, and I agree that my failure to do so will be interpreted as a free and knowledgeable acceptance of the terms of this release.  
3. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by the Company, or the employees, representatives or agents of the Company. 
4. ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with my attendance at the retreat. I acknowledge that I may come into contact with others who are not vaccinated for COVID, or may have been exposed to COVID.  I assume full responsibility for personal injury or illness to myself and further release and discharge the Company for injury, loss or damage arising out of my presence upon the facilities of the retreat, whether caused by the fault of myself, the Company or other third parties. 
5. INDEMNIFICATION. I agree to indemnify and defend the Company against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of the Company.
6. FEES. I agree to pay for all damages to the facilities of the Company caused by any negligent, reckless, or willful actions by me.
7. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under Arizona law. 
8. NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before enrolling. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. 
9. ARM'S LENGTH AGREEMENT. This Agreement and each of its terms are the product of an arm's length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity. 
10. ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement. 
11. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure.  Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation does not successfully resolve the dispute, then the parties may proceed to seek an alternative form of resolution in accordance with any other rights and remedies afforded to them by law. 

By completing my purchase, I agree that I have read and agree to the above.
